Jetpilot Affiliate Program: Terms and Conditions
Effective Date: 11 June 2025
Welcome to Jetpilot! Thanks for joining our Partnership Program. These following terms and conditions ("Agreement") apply to individuals who are accessing or using the Program, both as the merchant (“we” or “merchant”) and as a partner (“you” or “partner”) who refers customers to use a product or service from the merchant.
By participating in the Program, you agree to use the Program in the manner specified in, and are bound by, these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety, you are not authorized to register as a Partner or participate in the Program in any manner.
1. Enrollment in the Program
To begin the enrollment process, you must submit a complete and accurate Program application. We reserve the right to approve or reject any Affiliate Program Registration in our sole and absolute discretion. We will evaluate your application and notify you of your acceptance or rejection. You will have no legal recourse against us for the rejection of your Affiliate Program Registration.
2. Affiliate Responsibilities and Conduct
As an Affiliate, you agree to:
- Promote Jetpilot: Represent the Jetpilot brand and products in a positive, professional, and authentic manner.
- Compliance with Laws: Comply with all applicable laws, regulations, and industry best practices, including but not limited to the Australian Consumer Law and the Spam Act 2003. This includes providing clear and conspicuous disclosures that you may earn a commission from your promotions.
- Marketing Activities: You are solely responsible for your marketing activities. All marketing materials must be truthful and not misleading. Affiliate may advertise the merchant website on online channels such as Facebook, Instagram, or offline classified channels, ads, magazines, and newspapers.
- Prohibited Content:You may not promote Jetpilot on any website or platform that:
- Promotes sexually explicit materials.
- Promotes violence or illegal activities.
- Promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
- Contains any defamatory, libelous, or otherwise objectionable content.
- Infringes or otherwise violates the intellectual property rights of any third party.
- Brand Representation: You may not bid on any keywords in any pay-per-click advertising that are identical or confusingly similar to Jetpilot's trademarks. You may not use the Jetpilot name or any of its variations in your domain name or social media handles without our prior written consent.
3. Affiliate Links and Coupons
An affiliate link is automatically generated, but you can also generate an affiliate link for a specific product or collection. If a person clicks on someone else’s referral link and then later clicks on yours, yours is the one that counts.
An Affiliate might or might not be assigned to one coupon code with details and usage clarified on the Dashboard. If a customer both clicks on the affiliate link and uses the coupon code, you will not receive a double commission. If you’re not assigned a branded coupon, then you’re not allowed to promote the coupon.
4. Commissions and Payment
When you refer any customer who makes a purchase on our website, you will get a commission amount which is calculated based on our Commission structure. The commission amount is dependent on the order value and does not include extra fees (tax, shipping cost, etc.).
- Commission Rates: Commission rates will be determined by Jetpilot and will be communicated to you upon acceptance into the Program.
- Payment Schedule: Commissions will be paid within 5 days after thirty (30) days of the end of each calendar month. (e.g., Referrals from 1-31 May will be paid on 5 July).
- Payment Requirements:For an Affiliate to receive a commission, you need to specify the payment details in your Settings. To be eligible for payment, you must:
- Have a minimum of AUD $100 in accrued commissions.
- Provide us with a valid Australian Business Number (ABN) and indicate if you are registered for GST.
- Provide us with your accurate and up-to-date payment information.
- Invoices and GST: If you are registered for GST, you must provide us with a valid tax invoice for the commission amount, including GST.
- Fair Use and Transaction Status: Use of the Partner Program is subject to a fair use policy which gives the merchant the right to review each and every referral order. Payments will only be sent for transactions that have been successfully completed. The status of the commission is displayed in the Commission tab, and any paid commission will be listed on the Payment tab. Transactions that result in chargebacks or refunds will not be paid out.
5. Australian Business Number (ABN) and Taxation
- ABN Requirement: All Australian-based Affiliates are required to provide a valid Australian Business Number (ABN) to be eligible for commission payments. Failure to provide a valid ABN will result in the withholding of payments until one is provided.
- Tax Obligations: You acknowledge and agree that you are an independent contractor and not an employee of Jetpilot. You are solely responsible for your own tax position and for complying with all applicable tax laws, including but not limited to, the payment of income tax, Goods and Services Tax (GST), and any other taxes or levies on the commissions you earn through the Program.
- No Tax Advice: Jetpilot does not provide tax advice. We strongly recommend that you consult with a qualified accountant or tax advisor to understand your tax obligations.
- No Liability: Jetpilot is not liable for your tax position or for any failure by you to comply with your tax obligations. You agree to indemnify and hold Jetpilot harmless from any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your tax obligations.
6. Marketing Tools
We may share promotion media such as banners, logos, or specific collection promotions with you through the Marketing tool tab. You can download the media or get the HTML embed code in order to share on affiliate channels.
7. Network
If the Network tab is activated, a partner can invite others to become their downline affiliate. If any downline affiliate brings an order to the merchant shop, the upline affiliate will also get a network commission which depends on the merchant's settings. To invite other affiliates into the system, share the network link, and any other affiliate who clicks on that link and signs up will become a downline affiliate.
8. Cookies
We use a cookie to track people who have clicked on your link, so they need to be using cookies for us to track them. If a person doesn't allow cookies or clears their cookies, then we can't track them, so we can't pay earnings on that person's activity.
The cookie duration is stated on the Partner registration form. The tracking day will start from the time a customer clicks on the affiliate’s link or uses the coupon. Within the cookie time, every order made by this customer at the merchant's website will automatically result in commissions to the affiliate (there’s no need for the customer to click on the affiliate link again).
9. Intellectual Property
Jetpilot grants you a non-exclusive, non-transferable, revocable right to use our logos, trademarks, and other brand assets ("Jetpilot IP") solely for the purpose of promoting our products in accordance with this Agreement. You may not use the Jetpilot IP for any other purpose without our prior written consent.
10. Term and Termination
The term of this Agreement will begin upon our acceptance of your Program application and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party written notice of termination.
If an affiliate wishes to be removed from the affiliate program, they can do so by contacting: Customerservice@jpihq.com. Upon termination, you must immediately cease using all Jetpilot IP and remove all of our tracking links from your website and other marketing materials.
11. Disclaimers and Limitation of Liability
We make no express or implied warranties or representations with respect to the Program or any products sold through the Program. In no event will we be liable for any indirect, special, or consequential damages arising in connection with this Agreement or the Program. Our aggregate liability arising with respect to this Agreement and the Program will not exceed the total commissions paid or payable to you under this Agreement.
12. Confidentiality
You agree not to disclose any confidential information that you may obtain through your participation in the Program, including but not limited to, commission rates, marketing strategies, and customer information.
13. Modification
We may modify any of the terms and conditions in this Agreement at any time and at our sole discretion. If we modify this Agreement, we will provide you with notice of the changes. If the modifications are unacceptable to you, your only recourse is to terminate this Agreement. Your continued participation in the Program following our posting of a change notice or new agreement on our site will constitute binding acceptance of the change.
14. Governing Law
This Agreement will be governed by the laws of the State of Queensland, Australia, without regard to the conflict of laws principles thereof.
